Thank you for your interest in using the Events4kids services. By accessing our website, be it for information, as a Free Subscriber, Community Member, Event Organiser or Event Leader, you agree to comply with and be bound by these Terms, as applicable to you.

We strongly recommend you to go through the following terms and conditions:

Definitions used throughout these Terms and their interpretations:

  • Words like ‘Consumer’, ‘Purchaser’, ‘Parent or Guardian’, ‘Community Member’ or ‘you’ will refer to individuals who choose to create a Free Subscriber or Community Membership account, buy event tickets and interact within the community and by doing so confirm that they are over 18.
  • ‘Our’, ‘us’, ‘we’ and similar terms will indicate Events4kids
  • ‘Event Leaders’  will refer to individuals who choose to create an Event Leader account to advertise their events and may be present at the event or available to contact before the event takes place.
  • ‘Event Organisers’ refer to those that support Event Leaders and must hold either a Free or Community Membership account.
  • ‘Attendee’ is the person named on the ticket, that the ticket has been purchased for.
  • ‘Event’ refers to any listing on the Events4kids website that has a ticket available to purchase.

Other Terms that also apply: when handling and protecting your data Events4kids abide by our Privacy Policy.

Using Events4kids on behalf of an entity

By using our Services on behalf of an entity (such as on behalf of your employer or a club), you agree to these Terms on behalf of that entity and its Affiliates and you represent that you have the authority to do so. In that case, “you” and “your” will refer to that entity as well as yourself.

Who are we?

Events4kids is an events management and community platform. We offer a platform dedicated to home-ed events and a community for our members to stay connected. Through our services and products Event Leaders and Organisers can advertise events that offer tickets for sale to parents or guardians of home-educated attendees.

Events4Kids is not the creator, organiser, or owner of the events listed nor are we the seller of tickets, registrations or any merchandise on the Services. Instead, we provide our Services, which allow Event Leaders and Organisers to manage ticketing and registrations and promote their events.

If the Event Leader is hosting an event with paid tickets, the Event Leader will receive payments via their own Stripe (Payment Provider) account.  Events4Kids does not add a booking fee.  Events4Kids does not process the transaction.

Who are the Event Leaders?

The Event Leaders create and list the event, set the pricing and manage any event-relevant communications. They do so with sole responsibility for ensuring that their event and event listing is accurate and comply with any applicable laws, rules, and regulations and that what is delivered is as described.

Event Leaders will be listed in the Organisers section of the event listing.

Who are the Organisers?

Event Leaders may be supported by Event Organisers. All events will clearly state in the Organisers section the Event Leader plus, where applicable, the Organisers. If there is only one name listed that will be the name of the Event Leader.

Some events are small and only require the Event Leader to manage them. Some are large and therefore require several people to support them and ensure that the event is a success.

Creating an account on Events4kids

You can only purchase event tickets from the Website if you are eligible to enter into a contract and are at least 18 years old. Therefore parents or guardians wishing to purchase tickets for an attendee must have an account, either as a Free subscriber, Community Membership or as an Event Leader.

When creating an account you must enter accurate and truthful information and update it if it changes. We will remove anyone who is proven to have provided inaccurate information. We will not knowingly collect a child’s data directly from anyone under 18 years of age. If you believe someone under 18 has created an account you should inform us via admin@events4kids.co.uk immediately so that it is deleted.

Basis of Sale

  • The listing of an event on our Events4Kids does not constitute a contractual offer to sell the tickets. When an Order has been submitted on Events4Kids, we can reject it for any reason, although we will try to tell you the reason without delay.
  • The Order process allows you to check and amend any errors before submitting the Order. It is your responsibility to check that you have used the ordering process correctly.
  • By opting to purchase a Community Member Membership you automatically agree to our Terms & Conditions. If you have problems with any of the clauses listed below or do not agree with the risk allocations mentioned here, please do not create a membership.
  • Please note that Events4kids reserves the right to make changes, revisions, and amendments, or add/remove sections from this set of terms and conditions – without any prior notifications to you. Such changes will be duly reflected here.
  • These changes will relate to the date of purchase of any event tickets.
  • The price of the event ticket is listed clearly in the event description. This figure is non-negotiable and you agree not to contact the Event Leader to request a discount.
  • The ticket you purchase represents a revocable license for the attendee to access the event on the date specified on the ticket only. The license includes the revocable right to attend the event. This license can be revoked at any time by the ‘Event Leader’, ‘Organiser’ or ‘Events4kids’ at its sole discretion, without any prior notifications or compensation options. If the license is revoked, the attendee will not be granted entry to the venue.
  • Once purchased, tickets are delivered via email and a copy is available within your account. The Purchaser has to assume full responsibility for the event ticket, once received. Event4kids has no liabilities – financial, legal, or otherwise – in case the delivered tickets are printed and subsequently stolen, lost, damaged, destroyed or rendered unusable in any other way.
  • If you obtain your ticket(s) from any other unauthorised source, you take on the risk of those tickets turning out to be counterfeit or reported to be stolen. The Event Leader and Organiser have the right to dishonour such stolen/counterfeit tickets and declare them void.
  • The event tickets are delivered to you by email and are not meant to be used for illegal reselling, copying, reproducing, or misrepresenting in any form. You cannot use the ticket(s) for any promotional/advertising purposes either (including sweepstakes and competitions) without our prior approval. Any proven record of such activities will result in immediate seizure and cancellation of your ticket(s).
  • Please note that event tickets cannot be redeemed against cash, credits, or any other benefits.
  • Events4kids has the right to investigate if there has been any violation of the ticketing terms and conditions. In case of any conflicts, the decision of Events4kids will be deemed final (i.e. will remain the final arbiter in cases of disputes).

Fees, Transfers & Refunds

Fees

Events4Kids charges an annual Membership fee to Community Members and Event Leaders for the use of its services, including but not limited to; Groups, Forums, Chat, Messaging, discounts and Special Offers.

New members are entitled to a 30-day free trial period (“Free Trial”) during which they can cancel at anytime.  After the Free Trial period ends, members will be automatically enrolled into a paid subscription plan.

Payment for the Subscription Fee will be charged automatically to the member’s chosen payment method at the end of the Free Trial period and annually thereafter unless cancelled by the member.

Evenst4Kids do not charge any additional fees for the purchase of event tickets.

Consumers who choose a Free Subscriber account do not pay any fees.

Membership cancellation

Members may cancel their subscriptions at any time. However, no refunds will be provided for any unused portion of the subscription period.

To cancel your Community or Event Leader Membership subscription, please log in to your account, click subscriptions and choose downgrade or cancel.

Ticket Transfers

Transferring your purchased ticket to another attendee may be possible at the sole discretion of the Event Leader.

Refunds

  • The event service will be deemed to have been delivered in its entirety as soon as the event starts. From that point on, no refund requests will be entertained by the Event Leader.

  • If the attendee is not able to attend the event for a reason that is clearly stated in the event listing including but not limited to; age or height restrictions, ability to access the venue, date or time of the event you will not be eligible for any refunds or future credits.

  • If the event is cancelled for a reason out of the Event Leader or Organisers’ control including but not limited to; Government restrictions, Venue policies, weather-related problems, emergencies, or venue shutdown/evacuation the Event Leader has the sole and absolute right to reschedule the event, issue a full/partial refund, issue a future credit Coupon or not issue any refunds.

Please note that the decision of the Event Leader in such cases will be deemed final and binding.

  • If the event has to be rescheduled to another date, you will be notified of the date change and given the option to refuse the new date. In this situation, you must confirm your agreement to the change within the specified time limit, or else your ticket will be refunded.

  • In the case the event is fully cancelled, the refund will include ONLY the face value/printed value of the ticket(s). The purchaser cannot, under any circumstances, claim refunds for external associated charges.

  • Losses, if any, occurring due to foreign exchange fluctuations at the time of refunds, have to be borne by the purchaser. Events4kids cannot be, in any way, held liable for that.

  • All ticket sales are deemed as FINAL TRANSACTIONS. There will be no ticket returns/exchanges/cancellations for reasons not listed above.

Cancellations

Purchaser & Attendee Specific Conditions

  • By purchasing the event tickets, you automatically confirm that the attendee(s) meet any criteria stated in the Event Listing. If an Attendee does not meet the criteria listed for the event the responsibility falls to the Purchaser. The attendee will no longer be covered by the insurance provided by the Venue or Event Lead and no claims can be made against them or Events4kids in any respect. No refunds, full or partial, will be issued either.

  • By purchasing an event ticket and presenting the same at the venue, you give your consent to Events4kids, the Event Leader, the Organiser and the Venue to collect certain information about yourself (name, picture, date of birth, gender, address, etc.) for verification and storage. Please see our Privacy Policy for more details.

  • Events4kids, Event Leaders and Organisers do not take any responsibility for personal/financial damages caused to you at the venue, or for any items lost/stolen/misplaced at the venue. Financial reimbursement claims on these counts will not be entertained.

  • Events4kids, Event Leaders and Organisers follow a common ‘zero-tolerance policy’ towards unauthorised drug usage, alcohol consumption AND any type of behaviour/actions that can be interpreted as lewd or obscene, cause harm or upset to any other attendee or venue personnel. If you or your attendee are found in possession of prohibited items and/or if you indulge in any objectionable action, your participation in the event will be terminated immediately. Your event ticket(s) will become void from that point on and no refunds will be issued.

  • Please note that you purchase tickets of your own free will. As such, you do not have the right to initiate a chargeback claim or dispute on the provider of the credit card/debit card that had been used for the transaction. Further refund/return/cancellation requests will not be entertained either.

Disputes

  • We want everyone to be able to access and enjoy our events. We try to avoid any dispute, so we deal with complaints in the following way: If a dispute occurs following the purchase of a ticket you should contact the Event Leader in the first instance to find a solution. Event leaders may be contacted directly from the listed event or if the event is no longer listed, in the ‘View Organisers’ section of the website. If the Organiser is unable to resolve the dispute the Purchaser should contact admin@events4kids.co.uk, we aim to respond with an appropriate solution within 5 working days.

Release and Indemnification

  • Release. You won’t bring us into any disputes between you and a third party.

  • You hereby agree to release us (collectively with our respective officers, directors, agents, co-branders, licensors, payment processing partners, vendors, other partners, independent contractors and employees, the “Events4kids Released Parties”) from all damages (whether direct, indirect, incidental, consequential, or otherwise), losses, liabilities, costs, and expenses of every kind and nature, known and unknown, arising out of a dispute between you and a third party (including other Customers) in connection with any of the following:

        1. the Services or any event listed on the Services, including Event Leaders and Organisers’ Events;

        2. any failure to obtain or maintain any License, or any error in obtaining or maintaining any License;

        3. any Feedback (defined below) that you give or receive; or

        4. Your Content or Your Trademarks.
  • In addition, you waive any applicable law or statute, which says, in substance: “A GENERAL RELEASE DOES NOT EXTEND TO CLAIMS WHICH THE RELEASING PARTY DOES NOT KNOW OR SUSPECT TO EXIST IN HIS FAVOR AT THE TIME OF EXECUTING THE RELEASE, WHICH IF KNOWN BY HIM MUST HAVE MATERIALLY AFFECTED HIS SETTLEMENT WITH THE RELEASED PARTY.”
  • Indemnification. You agree to stand by us if a third party comes after us because of something you did or failed to do.
  • You agree to defend, indemnify, and hold harmless the Events4kids Released Parties from any damage (whether direct, indirect, incidental, consequential or otherwise), loss, liability, cost and expense (including reasonable associated fees) resulting from any claim, demand, suit, proceeding (whether before an arbitrator, court, mediator or otherwise) or investigation made by any third party (each a “Claim”) relating to or arising out of:
        1. your breach of these Terms (including any terms, agreements or policies incorporated into these Terms);
        2. your unauthorised use of the Services;
        3. your Licensure, any failure to obtain or maintain any Licensure, or any error in obtaining or maintaining any Licensure;
        4. any Feedback that you give or receive;
        5. your breach of any applicable local, national or other law, rule or regulation or the rights of any third party;
        6. our collection and remission of taxes; and
        7. if you are an Event Leader or Organiser, Your Events4kids Events (including where we have provided Services concerning those events) and Your Content and Your Trademarks, provided that in the case of (7), this indemnification will not apply to the extent that the Claim arises out of Events4kids’s gross negligence or willful misconduct.
  • We will provide notice to you of any such Claim, but our failure or delay in providing such notice will not limit your indemnification obligations except to the extent you are materially prejudiced by such failure. Also, in certain circumstances, we may choose to handle the Claim ourselves, in which case you agree to cooperate with us in any way we request.

Disclaimer of Warranties and Assumption of Risks by You

Our aim will always be to provide Services that meet your needs, but this is in case we don’t.

  • To the extent allowed under applicable laws, the Services are provided on an “as is” and “as available” basis. Events4kids expressly disclaims all warranties of any kind, express or implied, including implied warranties, title, non-infringement, and fitness for a particular purpose. For example, we make no warranty that:

        1. the Services (or any portion of the Services) will meet your requirements or expectations;

        2. the Services will be uninterrupted, timely, secure, or error-free; or

        3. the results that may be obtained from the use of the Services will be accurate or reliable.

  • We have no control over and do not guarantee the (i) quality, safety, success, accuracy, or legality of any event or Site Content associated with an event, (ii) accuracy of any information provided by Event Leaders or Organisers (including Feedback and Customers personal information shared with Organisers in connection with events), or (iii) ability of any Customer to complete a transaction.

  • We are not liable for the acts or omissions of any third parties, including third parties that help us provide the Services, that an Event Leader or Organiser chooses to assist with an event, or that you choose to use or contract with when using the Services.

  • You must assume risks for attendees that are inherent in attending in-person or online events

  • Some events may carry inherent risks and by participating in those events, you choose to assume those risks voluntarily on behalf of your attendee. For example, some events may carry risk of illness, bodily injury, disability, or death, and you freely and willfully assume those risks by choosing to participate in those events.

  • Most events on our platform are not hosted by Events4kids, but if and when you are the purchaser of tickets that is, you assume all risks.

  • When you attend an event hosted by us, you waive any claims and causes of action against the Events4kids Released Parties, the event producers and presenters, and their insurers, for liability, including for personal injury, property damage or wrongful death in connection with your attendance of the event.

  • The disclaimers will apply so long as they are allowed under the law.

  • The disclaimers in these Terms apply to the maximum extent permitted by law, including after the Termination of Terms if necessary as stated below. If any warranties are required by applicable law, they will be limited to the shortest duration allowed.

 

Termination of these Terms

  • By using our services you agree to our terms. We hope you’ll always want to be a part of Events4kids, but if you don’t you can terminate your agreement by logging in to your account and clicking Delete Account and no longer accessing our webpages.

  • If you are using the website without a membership (free or paid), your only option for these Terms to no longer apply is to stop accessing the Services indefinitely. So long as you continue to access the Services, even without a membership, these Terms remain in effect.

  • Please note that certain provisions will always remain applicable to both you and us. All provisions of these Terms that by their nature should survive termination of these Terms will survive (i.e., they will continue to apply to you) including all limitations on liability, releases, indemnification obligations, disclaimers of warranties, agreements to arbitrate, choices of law and judicial forum, and intellectual property protections and licences
